6. User Data means any information provided by You to Us, including but not limited to shapefiles (SHP), coordinates, land descriptions, and/or personal data uploaded by You for the use of Service and/or Website; and
7. Website means the site “www.fairatmos.com” including any information, services, contents, functionalities, products or features that form part of the Website as offered and/or managed by Fairatmos.

1. By using the Service and/or Website, You represent and warrant that:
   1. You will only use the Website and/or Service for their intended and lawful purposes.
   2. The Account that You created based on information that is true and accurate.
   3. You will keep your Account username and/or password secure and confidential. You shall not disclose any information of Your username and/or password to any third party.
   4. If you know or suspect any unauthorized use of Your account, You must promptly notify Us.
   5. You shall not assign or otherwise transfer your Account to any other person or entity;

2. Fairatmos represents and warrants that all information and/or data with regards to the Project that You provide to us will be kept confidential and used solely for the purpose of the Service. We will not, without Your prior written approval, use for Our own benefit, publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to Your detriment, any such information and/or data.

2. Fairatmos does not guarantee that the Website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Website for business and operational reasons.

1. Atmoscheck is a data-driven platform providing spatial analysis and preliminary carbon project assessments. You acknowledge that Atmoscheck provides indicative references only and does not constitute an absolute or definitive data source for carbon credit issuance or legal land status.
2. Reports and data displayed in Atmoscheck are generated using secondary sources, AI modeling, and satellite imagery. We do not warrant that the data is 100% accurate, complete, or reflective of real-time ground conditions. Data may change at any time based on updates to our source assets.
3. You represent that You have the legal right to upload and process any User Data (including shapefiles) provided to Atmoscheck.
   1. Fairatmos will store User Data securely and will not disclose it to third parties or use it outside the scope of the Service without Your permission.
   2. Your mobile number and email will be used for user identification, security verification, and system notifications. We will not sell or share this contact information with third parties for their marketing purposes.
4. You understand that you shall use any information generated by Atmoscheck a directional reference and exercise caution when interpreting the findings, as results are subject to limitations in data availability, methodology, and underlying assumptions specific to a quick scan. None of the information provided should be considered as a definitive projection or used as the sole basis for decision making, including but not limited relating to investment or operational decisions, as more analysis is required to fully assess eligible land.
5. While we update our asset data regularly, we do not guarantee that all data in Atmoscheck is the most recent version in real-time. Update schedules depend on the availability and updates provided by the original data sources.

1. The Website and Service, including Atmoscheck, are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Fairatmos disclaims all warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
2. To the extent permitted under applicable laws, in no event shall Fairatmos, its directors, employees, or partners be liable to You or any third party for any indirect, incidental, special, exemplary, punitive, or consequential damages whatsoever. This includes, but is not limited to, damages for:
